The prosecution seeking to have Sam Kerr found guilty on a charge of allegedly racially harassing a police officer has had a win in an English court on Tuesday.

Lawyers for the Crown Prosecution Service were granted an extra two days to lodge documents outlining their case against the Matildas superstar, who is facing a charge of racially aggravated harassment of a police officer stemming from an alleged incident in London on January 30, 2023.

The prosecution is expected to table evidence including witness statements from two police officers, one of whom has accused the Chelsea star of harassing him.

Legal representatives for the Crown now have until Thursday, English time, to table the documents.

The news follows the Chelsea star's legal team filing an outline of their case to either have her found not guilty or have the charge dismissed

Kerr's legal team lodged a written summary of their case - known as a skeleton argument - with the court last week. 

Their submission outlines the legal arguments and evidence they will be relying on to either have the charge thrown out or convince a jury Kerr is not guilty. 

The Mail exclusively revealed that the 30-year-old was charged with racially aggravated harassment of a police officer and entered a not guilty plea on March 4, and will now face a four-day criminal trial before a jury in February 2025.

A Metropolitan Police spokesperson confirmed that the incident, which took place on January 30, 2023, was sparked by a dispute over a taxi fare before Kerr allegedly used insulting, threatening or abusive words that caused alarm or distress to the officer.

Kerr was locked in a cell in a London police station on the night of the alleged offence, during which she is accused of calling the officer a 'stupid white bastard'. She is also alleged to have vomited in the taxi.

However, the 30-year-old's defence team will reportedly argue that she called the officer a 'stupid white cop'.

The Matildas captain first appeared at Kingston Crown Court via videolink, and spoke only to confirm her identity and to enter a not guilty plea to the charge.

Judge Judith Elaine Coello said it was understood that the footballer's defence would be that her intention was not to upset the policeman.

'I understand that the defence is that she didn't intend to cause alarm, harassment or distress to the officer, [her behaviour] did not amount to it and it was not racially aggravated,' the judge asked Kerr's barrister, Grace Forbes.

It has also been revealed that Kerr's legal team will try to have the charge thrown out at a hearing set down for April 26 due to abuse of process because it took almost a year for her to be charged.

During that hearing in March, Forbes asked the prosecution for video of what was described in court as a 'very short incident' and CCTV footage from outside the police station 'where the contact began and within the custody suite', according to a News Corp report.

In the UK, the term 'custody suite' is used to refer to an area in a police station or other building where people are held after being arrested.

Forbes told the court that she wants access to two clips from police body cameras, saying: 'Those instructing me have attempted to contact the prosecution about this but have not received a response.'

If she is convicted next year, the Matildas skipper faces a maximum sentence of two years in prison and could be deported from the UK in the worst-case scenario.
